General Terms and Conditions (GTC) for the Alla Capanna, Monte Comino
1. Application and conclusion of contract
These terms and conditions define the legal relationship between the guest and the mountain guesthouse Alla Capanna. They are valid for reservations of overnight stays, catering and other services. The guest informs all other participants about the GTC's of the mountain guesthouse. A contract becomes effective as soon as a booking of services is made verbally (by telephone) or in writing (e-mail, bookingtool. Group bookings as of 6 persons require a written confirmation, upon this confirmation the reservation becomes legally valid. A unilateral cancellation of the contract will in general result in a right to compensation.
2. Confirmation number of persons
The responsible person must inform the host of any changes in the number of participants and to inform of the exact number of participants by telephone up to 48 hours before arrival. Subsequent minor corrections (+/- 10%) must be made no later than 08:00 a.m. on the day of arrival, otherwise the unused booked service is subject to a charge and will be invoiced.
3. Annulation / cancellation of reservation
Seriously justified cancellations of a reservation up to 10 days before the travel date are free of charge, for groups of 6 persons or more such a cancellation is possible up to 20 days before the travel date. Cancellations within these periods must be refunded by the host. Cancellations made later will be regulated in point 4 and implemented accordingly. As a guarantee, the host is entitled to request a pre-payment or to ask for the credit card details with due diligence.
Unexcused and not cancelled services ("No show") will generally be charged with 100% of the booked service.
A free cancellation is possible if there is proof that the access or journey to the mountain guesthouse is not possible due to force majeure (e.g. precarious snow situation, avalanche danger, flood, storm, landslides, rockfall, etc.), but will only be granted after early agreement with the host. If it is possible for the guests to reach the mountain guesthouse without danger via an alternative route, the contract remains valid.
A cancellation of the tour due to injury, exhaustion, unexpected weather conditions etc. will be accepted, or in case of a proven emergency the costs will be covered by a travel and cancellation insurance policy. It is strongly recommended that you take out an insurance covering the cancellation of your holiday in the event of illness, accident, bereavement in the family, etc. For groups, we also recommend that participants make a pre-payment to the organizer before the cancellation period becomes effective, in order to protect the organizer from any costs.
4. Cancellation deadlines
➢ up to 10 days before the booked overnight stay - free of charge
➢ up to 24 hours before the booked overnight stay - 25% of the regular price*
➢ less than 24 hours before the booked overnight stay - 50% of the regular price
➢ "No show" - 100% of the regular price
* An extension of the deadline can be arranged in case of uncertain weather conditions.
5. Payment methods, prices and banking details
The invoice can be paid in cash (CHF), by TWINT, by EC-Direct (Maestro) or credit card (Mastercard, Visa). We can also invoice the amount, which must be paid within 10 days. Our prices are calculated in Swiss francs including VAT. The prices for overnight stays are per person incl. breakfast and dinner, and visitor's tax.

6. Important information and house rules
➢ All rooms will be ready for occupancy by 15:00 at the very latest. Please clear the rooms by 10:00 for cleaning.
➢ Breakfast is served between 08:00 and 09:00. Exceptions need an early arrangement.
➢ Dinner will be served at 19:00. There is no possibility for à la carte orders.
➢ The night's rest at 23:00 must be respected and accepted by all guests. All participants must be informed.
➢ In all rooms four-legged friends are not allowed. Dogs are only allowed on the terasse, but we appeal for absolute consideration for guests and staff.
7. Liability and damages
The mountain guesthouse Alla Capanna declines any liability for damages and loss of personal property. There will be a complaint for presumed damages to the inventory and the mountain guesthouse.
All written and verbal information from the host and staff, e.g. about path conditions, weather situations, hiking suggestions, etc., will be given with the greatest possible care and best knowledge and conscience. A liability for damages of any kind, which can result for a guest from the use of such information, is excluded. All decisions are in the responsibility of the guest or the group leader.
The booking contract is the legal basis for further negotiations between the parties in case of ambiguities and legal disputes.
